    ATTY. BARRY GUTIERREZ: We were expecting na lumabas nga iyong desisyon this week kasi iyon iyong ugong since last week. Pero handa na nga sana kami na magsasalita si VP before she left for her trip sa Australia. Pero ngayong lumabas na finally iyong desisyon na hindi nga nag-deliberation kaninang tanghali at baka ma-push na naman to next week, then business as usual tayo and we just have to wait again for iyong developments sa susunod na Tuesday.

    Pero very, very grateful kami sa lahat ng aming mga supporters, hindi lang sa Maynila at sa Naga, kundi sa aking pagkakaintindi mayroon din yatang naging gathering sa Baguio, mayroon ding naging gathering sa Cebu, mayroon ding gathering sa Cotabato at sa Cagayan de Oro. So very, very grateful kami for the outpouring of public support for the Vice President at iyong pagbabantay ng ating mga kababayan dito sa magiging prosesong ito.

    Iyong sa Supreme Court actually kaninang umaga, as of last night and mayroon na rin this morning, mayroon nang nagvi-vigil na mga ordinaryong mamamayan. Nagpunta doon at their own expense, nagbantay. Mayroon ding mga nag-start ng mga campaign sa social media calling on people to be vigilant and to go to Padre Faura this morning at ikinatutuwa namin iyon. Patunay lang ito talaga na iyong suporta para kay VP Leni mula noong 2016 hanggang ngayon ay patuloy. And we hope na sa susunod na pagkakataon na magde-desisyon ulit iyong PET sa October 15, the same level of vigilance and the same level of participation ay magpapatuloy.

    But in the meantime, nagbabantay at kahit papaano nagtitiwala doon sa PET that they will decide on the basis of their own rules and on the basis of the actual count. Yesterday, nag-file na si Atty. Romy Macalintal noong latest motion in connection with this case, asking for official copy of iyong results ng recount. Kasi if you remember, PET actually assigned iyong recount sa tatlong pilot provinces na in-identify ni Bongbong Marcos to a separate group. Natapos na ito several weeks ago, early September. Hanggang ngayon, wala pa kaming nakukuhang official copy ng results. Although mayroon na kaming idea kung ano iyong laman because obviously, iyong revisors namin were also part of iyong the counting, in the same way na iyong revisors ni Bongbong were part of the count.

    So if we get an official copy of the report, that will go a long way towards understanding ano iyong puwedeng maging direksyon nitong desisyon kasi very, very clear under Rule 65 of the PET’s own rules that if there is no substantial recovery established in the recount of the pilot provinces identified by the protestant, then that should be sufficient basis for dismissing iyong case. So we’ll wait for that; we’ll see ano iyong magiging developments. But in the meantime, we’re also waiting for the PET to rule on iyong latest motion na finile ni Atty. Macalintal, so I guess iyon na muna. May questions pa ba?

    RAPPLER: Sir, this is the third time that the Supreme Court is deferring action on the initial ballot revision process kahit matagal nang nai-submit ni Justice Caguioa iyong kaniyang report, and there have been a lot of speculations about the possible results, Sir. So ano pong mindset ngayon ng OVP regarding all these speculations and—because some of the critics are implying na bakit matagal—iyong the continued deferment seems to be suspicious. I’m wondering if the OVP shares the same sentiments?

    ATTY. BARRY GUTIERREZ: Well, that was the purpose behind iyong filing nga ni Atty. Romy Macalintal yesterday of iyong motion asking for an official copy of the results noong recount, iyong report. Kasi iyon nga, eh, hindi mo maiiwasan: lumabas na iyong balita, nandiyan na iyong report, nag-submit na yata ng draft decision si Justice Caguioa. Why the delay, ‘di ba? So sa amin, the easiest way, and the best way, to actually dispel any of these rumors—na actually hindi naman damaging sa amin, eh, pero damaging to the PET and the process itself—is to come out with the report. Make it public, hayaang makita ng mga tao, so we at least have a general idea where we’re going with this. So we hope that iyong PET will see fit to act expeditiously doon sa latest motion ni Atty. Macalintal.

    GMA NEWS ONLINE: Clarify ko lang. Sir, iyong copy noong results noong manual recount, wala kayong kopya, tama? Walang kopya both Robredo—the camp of the VP and Marcos?

    ATTY. BARRY GUTIERREZ: Wala kaming copy noong official report noong revisors, no, kasi hindi pa nire-release officially ng PET iyon. In fact… well, they have not made it public in any way, shape or form. Wala pang ganoon. Ang basis for the numbers na in-include in an earlier motion na finile ng lawyers ni VP was iyong unofficial numbers na nakuha namin as part of the report noong aming mga revisors. Kasi you have to remember, iyong recount was done with the participation of revisors from both parties, eh. So mayroon kaming idea anong resulta, obviously, kasi nandoon iyong mga tao namin, nandoon iyong mga tao ni BBM, and ito nga iyong basis for iyong assertion in an earlier motion we filed, na nag-gain pa ng 15,000 votes, more or less, si VP Leni, as a result of iyong recount in the three provinces. But as far as iyong official, final report na sinubmit to PET, none of the parties have a copy of that yet. Kaya iyon nga iyong hinihingi ni Atty. Macalintal kahapon doon sa kaniyang motion na finile before PET.

    GMA NEWS ONLINE: Sir, follow-up?

    ATTY. BARRY GUTIERREZ: Sure.

    GMA NEWS ONLINE: Mayroon po bang rule ang PET preventing them from releasing that report, or any earlier jurisprudence?

    ATTY. BARRY GUTIERREZ: None that I’m aware of, actually. At the end of the day naman, it’s subject to their discretion whether they will release it or not. Ultimately that’s what the motion of Atty. Macalintal is asking for: make a ruling kung dapat kaming makakuha nito o hindi. Pero at this point kasi, ang tingin din namin, it’s going to help not just the parties themselves—and by parties hindi lang kami, but also iyong party noong protestant, si Ginoong Marcos—but also to help dispel and correct any of the misunderstandings regarding nito. Kasi hindi mo maiwasan, eh. Ang tagal nang alam na mayroong report, ang tagal nang alam na mayroong draft decision. Pero walang lumalabas na official decision, walang official action pa from PET, sunod-sunod na deferment. In the meantime, if you open your social media feed, punong-puno ng mga conflicting reports kung ano ba talaga iyong bilang, kung ano ba talaga iyong hindi. So the best way to deal with that, ilabas na natin iyong report. Make it public. Anyway, I don’t think it will do any harm. But ultimately, you know, we will respect whatever decision that the PET will take with respect to release of this official report or not.

    ATTY. BARRY GUTIERREZ: Mahirap talaga ng walang nangyayari. [laughter] Si VP Leni—just to clarify—is leaving for Sydney, Australia this evening. She will be back on Saturday. She will be meeting with several Filipino communities while she’s there. The highlight of the trip will be the speech she will give tomorrow before iyong Australia-Philippines Business Council in Sydney. I believe she will be talking about women and business. Iyon iyong kaniyang ano doon… iyon iyong topic.

    Also, to be clear: the trip is not going to cause the taxpayers anything. Hindi ito china-charge sa kaniyang opisina. And she’ll be back by Saturday.
